Seb's post about, "Powerhouse collection documentation goes Creative Commons" is a good reminder:
"We figure that a clear license is probably the ground level work that needs to preceded a future API in any case."
I have a feeling (but will have to check) that "Brought to Life" used a CC license for that data, not that you'd know it from the legal blah page.
I have a feeling that the more rights the license gives the consumer, the harder it is to get agreed - does that ring true in your institutions?
